Governing the use of aestheticbusinessmasters.com.au and participation in ABM events, awards and programs

    1. Introduction & Acceptance

    These Website Terms of Use and General Conditions (Terms) govern access to and use of the website located at https://aestheticbusinessmasters.com.au (Website), and participation in any conference, summit, awards program, podcast, publication, digital resource, membership, sponsorship, exhibition or other activity conducted by Aesthetic Business Masters Pty Ltd (ABN 69 613 828 238) (ABM, we, us, our).

    By accessing the Website, registering for an event, submitting an award entry, applying to speak, sponsor or exhibit, or otherwise engaging with ABM, you (you, your, User) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or engage our services.

    These Terms should be read together with our Privacy Policy & Privacy Collection Notice, our Awards Program Rules, Judging Code & Entry Terms, and our Governance, Diversity & Corporate Responsibility statement, each of which is incorporated by reference.

    2. About Aesthetic Business Masters

    ABM is Australia’s premium business education platform for aesthetic, medical, beauty and wellness entrepreneurs. We deliver business conferences, educational summits, an awards program (the Aesthetic Business Awards), podcasts, articles, digital education, marketing campaigns, online resources, networking events, media publications and industry research for clinic owners, clinicians, practice managers, suppliers and industry partners.

    3. User Responsibilities & Acceptable Use

    As a condition of using the Website or attending any ABM event, you agree that you will:

    • provide accurate, current and complete information when registering, applying or submitting any material;
    • use the Website and attend ABM events in a manner consistent with applicable law and generally accepted standards of professional conduct;
    • treat other delegates, speakers, sponsors, exhibitors, judges, staff and contractors with courtesy and respect, consistent with our Governance, Diversity & Corporate Responsibility statement;
    • not engage in conduct that is unlawful, defamatory, harassing, discriminatory, fraudulent or misleading;
    • not attempt to interfere with, disrupt or gain unauthorised access to the Website, any related systems, or any event platform;
    • not use automated means (including scraping, harvesting or data-mining tools) to extract content from the Website without our prior written consent;
    • not misrepresent your affiliation with ABM, or use ABM’s name, awards, or branding in a manner likely to mislead.

    We reserve the right to refuse registration, remove content, suspend access, or decline entry to any individual whose conduct we reasonably consider inconsistent with these Terms or with the standards of a premium, professional business event.

    4. Intellectual Property

    4.1 Ownership

    All content on the Website and in ABM materials — including text, graphics, logos, the ABM and Aesthetic Business Awards names and marks, images, video, audio, podcast recordings, course materials, presentation decks and compilations of data — is owned by or licensed to ABM and is protected under the Copyright Act 1968 (Cth) and applicable trade mark law, unless otherwise indicated.

    4.2 Trade Marks

    “Aesthetic Business Masters”, “Aesthetic Business Awards” and associated logos are trade marks of ABM (whether or not registered). No licence is granted to use these marks except as expressly authorised in writing by ABM (for example, an approved “finalist” or “winner” badge issued under the Awards Program Rules).

    4.3 Permitted Use

    You may view, print or share limited excerpts of Website content for personal, non-commercial reference, provided you do not remove any copyright or trade mark notice. Any other reproduction, republication, adaptation, distribution or commercial use requires our prior written consent.

    4.4 User-Submitted Material

    Where you submit material to ABM (including award entries, speaker applications, testimonials, photographs or podcast contributions), you grant ABM a non-exclusive, perpetual, royalty-free, worldwide licence to use, reproduce, adapt and publish that material for the purposes of operating and promoting ABM’s events, awards and publications, as further described in our Privacy Policy and Awards Program Rules. You warrant that you own or are authorised to grant these rights and that the material does not infringe any third party’s rights.

    5. Event Registrations, Ticketing & Payments

    5.1 Registrations

    Delegate, speaker, sponsor and exhibitor registrations are accepted subject to these Terms and any additional terms specified in the relevant registration or agreement (including sponsorship or exhibitor agreements). Registration is confirmed only upon our written confirmation and (where applicable) receipt of payment.

    5.2 Ticket Sales

    Tickets are sold subject to availability. Prices are quoted in Australian dollars (AUD) and are inclusive of GST unless stated otherwise. We reserve the right to vary pricing, packages and inclusions for future events or ticket releases at our discretion.

    5.3 Refunds, Cancellations, Transfers & Substitutions

    Our approach to refunds and cancellations reflects standard, fair industry practice and your rights under the Australian Consumer Law, which cannot be excluded:

    • Delegate-initiated cancellations made in writing within the timeframe specified on the relevant event page or ticket terms may be eligible for a refund (less any processing fee) or credit toward a future ABM event, at ABM’s discretion.
    • Substitutions (transferring a ticket to another attendee from the same organisation) are generally permitted on reasonable written notice to ABM prior to the event.
    • Where ABM cancels, postpones, or materially relocates an event, delegates will be offered a credit, transfer to the rescheduled event, or refund, as set out in the applicable event communication.
    • Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded.

    5.4 Force Majeure

    ABM will not be liable for any failure or delay in performance (including postponement, relocation or cancellation of an event) caused by circumstances beyond its reasonable control, including natural disaster, extreme weather, pandemic or public health order, industrial action, venue unavailability, act of government, or failure of essential infrastructure. Where reasonably practicable, ABM will offer affected delegates a credit or transfer to an alternative date.

    6. Photography, Videography, Podcast Recording & Media Release

    ABM events, summits and studio sessions may be photographed, filmed, live-streamed or recorded for promotional, editorial, educational and archival purposes, including for social media, website, podcast and media publication.

    • By attending an ABM event or appearing on an ABM podcast, you consent to being photographed, filmed and/or recorded, and to ABM using your name, image, voice and likeness in connection with such material, without further compensation, unless otherwise agreed in writing.
    • If you do not wish to be photographed or recorded, please notify ABM staff on-site in writing so reasonable accommodations can be considered (noting that general audience or venue-wide shots may still include you incidentally).
    • Personal recording devices, professional cameras and audio recording equipment may not be used to record sessions, speakers or podcast content without ABM’s prior written consent, in order to protect speaker intellectual property and the delegate experience.

    7. Website Accuracy, Third-Party Links & Advertising

    7.1 Accuracy

    We take reasonable care to ensure information on the Website is accurate and current, but we do not warrant that all content is free of error, complete, or up to date. Program details, speaker line-ups and pricing may change without notice.

    7.2 Third-Party Links & Affiliate Links

    The Website may contain links to third-party websites for convenience. ABM does not endorse and is not responsible for the content, accuracy or practices of any third-party site. Some links may be affiliate links, meaning ABM may receive a commission from a qualifying purchase; this does not affect the price you pay.

    7.3 Advertising & Sponsored Content

    Content on the Website or at ABM events may include paid advertising, sponsorships or sponsored content. Where required, such content will be clearly identified as sponsored or paid partnership content in accordance with Australian Consumer Law requirements regarding misleading and deceptive conduct.

    8. Competitions & Promotions

    From time to time ABM may run competitions or promotions (separate from the Aesthetic Business Awards, which are governed by our Awards Program Rules, Judging Code & Entry Terms). Any such competition will be subject to specific promotion terms published at the time, which will address eligibility, entry method, prizes, and (where required by law) permit numbers for the relevant Australian jurisdiction.

    9. Limitation of Liability & Indemnity

    9.1 Limitation of Liability

    To the maximum extent permitted by law, ABM excludes all liability for indirect, special or consequential loss arising from your use of the Website or attendance at an ABM event, including loss of profits, loss of business opportunity or reputational loss. Where ABM’s liability cannot be excluded under the Australian Consumer Law (including the consumer guarantees relating to services), ABM’s liability is limited, at ABM’s election, to the resupply of the relevant service or the cost of resupply.

    9.2 Indemnity

    You agree to indemnify and hold ABM, its directors, officers, employees, contractors and agents harmless against any claim, loss, damage or expense (including reasonable legal costs) arising from your breach of these Terms, your negligent or wrongful act or omission, or your infringement of any third party’s rights.

    9.3 Professional & Medical Content

    Any business, clinical, financial or strategic content presented at ABM events or in ABM publications is provided for general educational and informational purposes only. It does not constitute medical, legal, financial or professional advice specific to your circumstances, and attendees should seek independent advice before acting on any information presented.

    10. Governing Law & Dispute Resolution

    These Terms are governed by the laws of [STATE/TERRITORY], Australia. Any dispute arising out of or in connection with these Terms will first be referred to good-faith negotiation between the parties and, if unresolved within a reasonable period, may be submitted to mediation before either party commences court proceedings, save for urgent injunctive relief.
